General Terms and Conditions
Publications can be ordered directly from the publisher using our book order form – our terms and conditions are set out below.
In addition, our General Terms and Conditions apply, provided that their individual provisions do not expressly refer solely to consumers within the meaning of Section 13 of the German Civil Code (BGB).
1. Retention of title
By placing an order, the customer agrees to the terms and conditions of delivery set out below by the Heinrich-Barth-Institut e.V. The goods remain our property until full payment has been received. Unless otherwise stated, our prices include VAT but exclude delivery charges (see below).
2. Discount for booksellers
The Heinrich Barth Institute e.V. offers booksellers (resellers) a discount on the retail price of the titles ordered, after deduction of statutory VAT.
For print titles subject to statutory fixed retail prices, we offer a discount of thirty per cent (30%).
3. Shipping
Unless otherwise agreed, the Heinrich-Bart Institute e.V. delivers ex-warehouse to the delivery address specified by the customer. Our delivery charges are based on handling and material costs, as well as postage: charges are calculated according to weight categories.
4. Due Date and Payment
The purchase price for products ordered by the customer and supplied by the Heinrich-Barth-Institut e.V. is payable immediately upon delivery and without deduction. The goods delivered remain the property of the Heinrich-Barth-Institut e.V. until the invoice amount has been paid in full. A reminder fee of €5.00 will be charged for payment reminders. For first-time orders or larger order quantities, we reserve the right to require payment in advance before delivery.
5. Warranty
If the goods delivered are found to have a defect for which the Heinrich-Barth-Institut e.V. is responsible, the customer is obliged to notify the Heinrich-Barth-Institut e.V. of this without delay. In the event of justified complaints regarding obvious defects within two weeks of delivery and regarding non-obvious defects within six months of delivery, the Heinrich-Barth-Institut e.V. may either repair the goods or supply a replacement. If the repair or replacement fails, the purchaser may withdraw from the contract or demand a reasonable reduction in the purchase price.
6. Data privacy
The Heinrich-Bart-Institut e.V. processes and uses the customer’s personal data in accordance with the applicable data protection legislation and solely to the extent necessary for the conclusion, performance or amendment of the contract of sale, as well as for the fulfilment of the Heinrich-Bart-Institut e.V.’s legal obligations, e.g. commercial law retention obligations (Article 6(1)(b) of the GDPR ).
